Rental/Lease Polices and Contracts

Student (Academy) Rentals

  • Free repair and adjustments during rental (excluding strings, heads, sticks)
  • Exchange instrument during 1st month with 100% credit
  • No rental fees will be refunded once the instrument has been played

RENT – TO – OWN

All rentals are month to month. 100% of rent goes towards the purchase of the new, used, or previously rented instrument. No interest. This instrument remains the property of Musicians’ Repair & Sales until the account is paid in full.

EARLY PAY OFFS

At your request, we will give an early pay discount of 50% off the unpaid balance of your new, used, or previously rented instrument if rental payments are current.

TRADE INS

During your rental term, your instrument can be traded in towards a new upgraded instrument or larger sized violin/viola/cello/bass. If this is done within four (4) months 100% of your rental credit can be applied; within twelve (12) months 75%; within eighteen (18) months 60%; and within twenty-four (24) months 50% can be applied. Trade-ins are toward like instruments.

RETURNS

You may return the instrument to Musicians’ Repair & Sales during regular business hours without further obligation, provided all monthly rental fees are current and the instrument is in reasonable condition.

ADDITIONAL CHARGES

In addition to the monthly rental payment necessary to acquire ownership, you agree to pay us any of the following charges, which will be imposed under this agreement. We recommend you read the contract for an explanation of these charges.

a.             Reinstatement fee – You agree to pay us a reinstatement fee of $10.00 if this Agreement is reinstated after the musical instrument has been returned to us.

b.             Late charge – You agree to pay us a late charge of $5.00 if the rental payment is more than three (3) days late.

c.             Returned check charge – You agree to pay us a $25.00 service charge on all returned checks. We do not redeposit returned checks.

d.             Court costs/Attorney fees/Collection fees – You agree to pay court costs/attorney fees/collection agency fees if necessary, to collect outstanding charges on your account. You also agree to pay $60.00 for each court appearance made by a Musicians’ Repair & Sales representative in the collection process.

e.             Repossession fees – You agree to pay a fee of $25.00, if it becomes necessary to repossess your instrument.

LESSEE LIABILITY

You agree to be responsible for this musical instrument. You agree to pay for any deliberate or malicious damage. This would include any repairs performed by someone other than Musicians’ Repair & Sales. In the event of any accidental loss, theft, or destruction of this musical instrument, you agree to place a claim with your insurance company for its replacement. Musicians’ Repair & Sales will credit any deductible needed to replace the instrument with an instrument of like quality and condition. The value of lost, stolen, or damaged musical instruments shall be its fair market value on the date it is lost, stolen, damaged or destroyed.

REINSTATEMENT RIGHTS

If you fail to remit any rental payment when due, you have the right to reinstate this agreement without losing any rights or options you previously acquired under this agreement. If we have not yet requested return of the musical instrument and the musical instrument has not been returned to us, you may reinstate the agreement by paying to us all rental payments and late charges then due. If the musical instrument has been returned to us, then you may reinstate this agreement only if: (a) you returned the musical instrument to us prior to or promptly following our request for return of the musical instrument; (b) no more than 60 days elapsed since the date you returned the musical instrument to us; (c) the same or like condition instrument is available and; (d) you pay to us all rental payments and late charges then due and a reinstatement charge of $10.00. If this agreement is terminated by us for any reason other than your failure to make a rental payment when due, you have no right to reinstate this agreement.

FORBIDDEN ACTS

You agree that, until you own the musical instrument, you will not sell, sublease, mortgage, pawn, pledge, encumber or otherwise dispose of the musical instrument.

TITLE TO MUSICAL INSTRUMENT

We are and shall always remain the owner of the musical instrument until you have paid all amounts necessary to acquire ownership of the musical instrument. If you do not renew this agreement, or if this agreement is terminated, we have the right to take possession of the musical instrument. You agree to make the musical instrument available to us without delay and to permit us to retake possession of the instrument.

TERMINATION / DEFAULT

You may terminate this agreement at any time by returning the instrument to:

1.             Musicians’ Repair & Sales during regular business hours.

2.             NO RENTAL PAYMENT WILL BE REFUNDED TO LESSEE ONCE THE MUSICAL INSTRUMENT HAS BEEN PLAYED. You must return the musical instrument to us in good working order and condition, ordinary wear and tear excepted. You must also pay us all rental payments, sales tax, and other charges due through the date the musical instrument is returned to us. We may terminate this agreement without notice if you fail to make any rental payment when due, breach any term of this agreement, or move from your present address without notification to us within (5) five days.

CHANGE OF ADDRESS / EMPLOYMENT

If you change employment or place of residence, you agree to give us your new information and phone number within two (2) weeks. If you move outside of Indiana, you agree to pay for your instrument in full or return it within two (2) weeks. Any other arrangements must be negotiated with the store owner.

 

BY SIGNING BELOW, YOU AGREE TO THE TERMS OF THIS AGREEMENT AND ACKNOWLEDGE THAT YOU HAVE READ AND FULLY UNDERSTAND THE TERMS OF THIS AGREEMENT. BY SIGNING BELOW, YOU ACKNOWLEDGE THAT YOU HAVE RECEIVED AND COMPLETED A SIGNED COPY OF THIS AGREEMENT. BY SIGNING BELOW, YOU AUTHORIZE US TO REVIEW YOUR CREDIT AND EMPLOYMENT HISTORY.

 YOU AGREE TO NOTIFY US IMMEDIATELY IF YOU CHANGE YOUR ADDRESS, PHONE NUMBER, OR EMPLOYMENT STATUS.

Step-Up (Symphony) Rentals

Lease Contracts

LEASE CREDITS

Lease payments may be applied to the purchase of an upgraded new instrument. 100% credit, if applied, in the first (12) twelve months, 75% credit, if applied, between (12) twelve and (18) eighteen months, 50% credit, if applied, between (18) eighteen and (24) twenty-four months. No credits are applied after (24) twenty-four months. Credits are never applied to used instruments. Credit will only be available if the instrument is returned in good condition, and without extensive maintenance during your lease. Normal wear and tear are expected. Credits are only applied to like instruments.
